This Landscaping Contract (the “Agreement”) is made and entered into as of [DATE] by and between [CLIENT NAME], residing at [CLIENT ADDRESS] (hereinafter referred to as “Client”), and [CONTRACTOR NAME], residing at [CONTRACTOR ADDRESS] and doing business as [BUSINESS NAME] (hereinafter referred to as “Contractor”).

1. Scope of Work

Contractor agrees to perform the following landscaping services (the “Services”) at the Client’s property located at [PROPERTY ADDRESS]:

  • [Detailed description of the first service, e.g., Design and installation of a new flower bed along the front walkway, including selection and planting of [NUMBER] [PLANT TYPE] and mulching with [MULCH TYPE].]
  • [Detailed description of the second service, e.g., Removal of existing lawn in the backyard and installation of [SQUARE FOOTAGE] of new [GRASS TYPE] sod.]
  • [Detailed description of the third service, e.g., Installation of an irrigation system, including [NUMBER] sprinkler heads and timer, according to the attached design.]
  • [Detailed description of the fourth service, e.g., Trimming and pruning of all shrubs and bushes on the property.]
  • [Detailed description of the fifth service, e.g., Application of fertilizer and weed control to the entire lawn.]

A detailed drawing or plan illustrating the scope of work is attached as Exhibit A and incorporated herein by reference. Any changes to the scope of work must be agreed upon in writing and signed by both parties. Additional charges may apply for changes to the scope of work.

2. Contract Price and Payment

The total contract price for the Services is $[TOTAL PRICE] (the “Contract Price”).

Payment shall be made according to the following schedule:

  • [PERCENTAGE]% deposit of $[DEPOSIT AMOUNT] due upon signing of this Agreement.
  • [PERCENTAGE]% payment of $[PAYMENT AMOUNT] due upon completion of [MILESTONE, e.g., installation of sod].
  • [PERCENTAGE]% payment of $[PAYMENT AMOUNT] due upon completion of [MILESTONE, e.g., irrigation system installation].

Payments shall be made in [PAYMENT METHOD, e.g., check, cash, credit card]. Late payments may be subject to a late fee of [PERCENTAGE]% per month.

3. Start Date and Completion Date

Contractor shall commence the Services on or about [START DATE] and shall complete the Services on or before [COMPLETION DATE], subject to weather conditions and other unforeseen delays. Contractor will use commercially reasonable efforts to complete the Services by the Completion Date. If delays occur, Contractor will promptly notify Client.

4. Permits and Approvals

Client is responsible for obtaining all necessary permits and approvals required for the Services. Contractor will provide Client with any information necessary to obtain such permits and approvals.

5. Materials and Equipment

Contractor shall provide all necessary materials and equipment to perform the Services, unless otherwise specified in this Agreement. All materials will be of good quality and suitable for the intended purpose. Client may specify preferred brands or types of materials, subject to price adjustments.

6. Access to Property

Client shall provide Contractor with reasonable access to the property during normal business hours to perform the Services. Client shall also ensure that the property is free of any obstructions that may hinder Contractor’s work.

7. Insurance and Liability

Contractor shall maintain adequate insurance coverage, including general liability insurance and workers’ compensation insurance. Contractor is responsible for any damage caused by Contractor’s negligence. Client is responsible for their own property and belongings.

8. Warranty

Contractor warrants that the Services will be performed in a workmanlike manner and in accordance with industry standards. Contractor provides a warranty of [DURATION, e.g., one year] on [SPECIFIC ITEMS, e.g., plants and workmanship], from the date of completion. This warranty does not cover damage caused by acts of God, neglect, or improper maintenance by the Client. Replacement of plants under warranty is limited to one instance.

9. Termination

This Agreement may be terminated by either party upon [NUMBER] days written notice if the other party materially breaches this Agreement. Client may also terminate this Agreement upon written notice if the Contractor fails to commence the Services within [NUMBER] days of the Start Date. In the event of termination by Client before project completion, Client agrees to compensate Contractor for all work performed and materials purchased up to the date of termination, plus reasonable demobilization costs.

10. Dispute Resolution

Any disputes arising out of or relating to this Agreement shall be resolved through [DISPUTE RESOLUTION METHOD, e.g., mediation] in [CITY, STATE]. If mediation is unsuccessful, the parties agree to submit to binding arbitration in accordance with the rules of the [ARBITRATION ORGANIZATION, e.g., American Arbitration Association].

11. Governing Law

12. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral or written.

13. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Notices

All notices under this Agreement shall be in writing and shall be deemed to have been duly given when delivered personally or sent by certified mail, return receipt requested, to the addresses set forth above.

15. Acceptance

By signing below, the parties acknowledge that they have read, understood, and agree to be bound by the terms and conditions of this Landscaping Contract.
